Terms of Service

We operate from Mumbai, India, with a presence in Lewes, Delaware, USA. Our registered address and contact details are listed in the Contact Us section at the end of these Terms.

If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms on its behalf, and "you" refers to that organisation. Separate written agreements (for example a Master Services Agreement, Statement of Work, or employment or contractor agreement) take precedence over these Terms where they conflict.

The Service is not directed at children. If we learn that someone under 18 has provided us with personal data, we will delete it as described in our Privacy Policy.

Content on the Service is provided for general information only and does not constitute an offer or a binding commitment. Any engagement between MND and a Client, or between MND and a Candidate, is governed by a separate written agreement. We may change, suspend, or discontinue any part of the Service at any time.

We use this information only to respond to your enquiry, follow up about our services, and manage our business relationship with you, as described in our Privacy Policy. We do not sell this data, and we use it in line with Meta's Platform Terms and Developer Policies. Your use of Meta's products is also governed by Meta's own terms and policies, for which we are not responsible. You can ask us to delete the data we received from Meta at any time — see our Data Deletion Instructions page.

You must not: submit false, misleading, or someone else's information; upload malware or harmful code; attempt to gain unauthorised access to the Service, our systems, or other users' data; scrape, crawl, or harvest data from the Service except as permitted by our robots.txt; interfere with or overload the Service; or use the Service to send spam or unsolicited communications. We may suspend or block access for anyone who breaches these rules.

You grant us a non-exclusive, royalty-free licence to store, process, and share the information you submit with prospective Clients or service providers, solely to provide the Service and as described in our Privacy Policy. Submitting an application does not guarantee an interview, placement, or engagement.

This restriction applies during the tenure of any contract, or for twenty-four (24) months from the date of introduction, whichever is later. If a Client or Candidate solicits or works with the other without our consent, they will be liable to pay us a one-time fee equal to two (2) times the yearly cost we charged the Client, unless a separate written agreement says otherwise.

Payments are processed by third-party payment processors such as Razorpay and Stripe; we do not store your card details. Unless otherwise agreed in writing, invoices are payable within the period stated on the invoice, and late payments may result in suspension of services.

The MyNextDeveloper and MND names, logos, and trade dress may not be used without our prior written consent. You may view and share links to our content for personal, non-commercial purposes, but you may not copy, modify, republish, or distribute it without permission.

By submitting feedback you agree that it contains no confidential or third-party proprietary information, and you grant us a perpetual, irrevocable, royalty-free, worldwide right to use it for any purpose.

We are not responsible for the content, privacy practices, or availability of third-party services. Your use of them is governed by their own terms and policies.

We make no representations as to the completeness, security, reliability, accuracy, or availability of the Service, and your use of it is at your own risk. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, non-infringement, and fitness for a particular purpose.

Where liability is found on our part, it is limited to the amount you paid us for the products or services giving rise to the claim. Some jurisdictions do not allow certain limitations, so these may not apply to you.

This includes reasonable legal fees and costs incurred in connection with any such claim.

You may stop using the Service at any time and ask us to delete your data as described in our Privacy Policy and Data Deletion Instructions. Sections that by their nature should survive termination — including non-solicitation, intellectual property, disclaimers, and limitation of liability — will survive.

Our failure to enforce any right or provision of these Terms is not a waiver of that right. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.

We will update the "Last updated" date at the top of this page and, for material changes, may also notify you by email or a notice on the Service. Continued use of the Service after changes are posted means you accept the revised Terms.
